Amazon Worker’s $565 payout

The hundreds of Amazon employees in California who meet the eligibility requirements will receive a portion of the class action settlement against Amazon.

According to the class action settlement notices, Amazon and the plaintiffs collectively proposed to settle the lawsuit with a $3 million settlement. The notice claims that individual Amazon workers of class members can receive approximately $565 payout out of the Net Settlement fund.

The lawsuit against Amazon was filed in 2021 by the plaintiff Kryzhanovskiy claiming that Amazon has violated the Labor code as they failed to calculate and pay overtime wages to certain employees who earned signing bonuses.

Who will receive the Amazon’s Worker payout?

You will receive Amazon’s class action settlement payout on a signing bonus if you meet the following eligibility requirements:

• You were or are an Amazon Non-exempt employee in California between 22 July 2017 and 7 November 2023.
• You have received a signing or sign-on bonus in the same workweek when you have worked overtime, including double time.

According to reports, the class members included all current and former employees of Amazon who worked during the determined class period. The court notice estimates 3,331 class members under the Amazon Signing bonus settlement.

The eligible class members must have already received the notice of pendency of class action settlement against Amazon.

Distribution of Amazon’s $3 million Settlement Fund

The proposed $3 million settlement was preliminary approved by the court on 22 March 2024 and the settlement amount or Gross settlement fund (GSF) will be distributed among the following:

• The Settlement Administrator fee and the cost of administering the settlement will be paid from the GSF, estimated to be around $25,000.
• The Defendant and plaintiffs have allocated the $100,000 of the GSF to civil parties awarded under the California Labour Code PAGA Act.
• The court has approved the class representatives’ payments of $10,000 for Plaintiff Kryzhanovskiy and $ 7,500 for Plaintiff Salazar for their service to the class.
• The Class attorney fees and cost to represent the class members is one-third of the GSF, approximately $1,000,000.
• After subtracting all the entitled payments from the GSF, the net settlement fund is expected to be around $1,827,500. The NSF will be distributed among the class members based on the following factors:

• Number of workweeks between class periods.
• Class members whose employment ended will have an additional four work weeks to calculate their individual settlement payment.

According to the notice, 50% of participating class member payout is treated as wages reported on the W-2 Form and the rest as penalties and interest reported on Form 1099.

The exact amount of individual settlement member payout will be hard to determine until the settlement administrator knows the number of participating class members.

The last date to exclude from the settlement for the class member was 17 June 2024, so soon the settlement administrator will analyze the number of class members who will receive the payout.

The Plaintiffs have estimated the payout for the participating settlement member around $565.43.

Amazon’s current and former non-exempt workers who meet the eligibility requirements of the class action settlement would automatically receive the payout on their bank accounts except the class members who have excluded themselves from the settlement before the response deadline, 17 June 2024.

The class members can expect the signing bonus settlement payout after the final hearing of the class action settlement. Generally, the court directs the settlement administrator to pay the settlement payments to the class members’ accounts.

The court has given the preliminary approval for the settlement, and the final hearing of the signing bonus settlement against Amazon will be held in the Robert E. Coyle US courthouse, 2500 Tulare Street, California on 10 September 2024 at 9:00 AM.

The court would decide whether the settlement should be approved as a fair or adequate settlement to proceed further. The court will also approve the class counsel fees, administrator fees & cost of administering the settlement, class representatives payment, and the payment of the State of California.
